Terms*

• All deliveries will be priced at $2.399 gallon regardless of Tower Energy’s current retail price.
• By executing this contract you are agreeing to Automatic Delivery beginning September 1, 2009 and
  deliveries will continue on Automatic basis until revoked in writing by you.
• New customers must contact Tower Energy LLC when their tank level is at ¼ full to initiate the first de-
  livery. All deliveries must begin no later than September 1, 2009.
• There is a 150 gallon minimum delivery on any WILL CALL deliveries requested. Will call deliveries
  under 150 gallons will be subject to a delivery charge of $75.00.
• Oil purchased under this contract cannot be reserved for later use. This contract expires on April 30,
  2010 or upon the use of the purchased gallons. Any credit due under this contract can be applied against
  future deliveries at the prevailing market price. There are NO REFUNDS under this contract.
• Purchases made under this contract are encouraged to be based on the number of gallons required for the
  contract term (September 1, 2009 through April 30, 2010) Failure to use 75% of the purchased gallons
  will result in a 50 cents per gallon penalty on the unused gallons. This contract is not assignable.
• Tower Energy LLC reserves the right to refuse delivery if there is an outstanding balance on your account
  or you fail to maintain a properly vented oil storage tank.
• You agree to excuse Tower Energy, LLC for nonperformance under this contract to the extent that such
  failure to perform is due to an uncontrollable force. Uncontrollable forces maybe, but are not limited to;
  unusually severe weather conditions, acts of God, war, or terrorism, failure of public utilities, or supply
  constraints imposed by our suppliers.
